These Terms of Service ("Terms") govern your use of holachela.com and your purchases from CHELA, a brand operated by Morningside Ventures LLC, 21200 NE 38th Ave, Aventura, FL 33180, United States ("CHELA", "we", "us"). By using our site or placing an order, you agree to these Terms.

1. Our products

Every CHELA is handcrafted in Argentina from natural leather. Natural markings, small variations in grain and color, and slight differences from the photos are part of the character of each piece and are not defects. We do our best to show colors accurately, but they may look different on your screen.

2. Prices and currency

Prices are shown in US dollars (USD), except in Argentina, where they are shown in Argentine pesos (ARS). Prices do not include shipping, which is shown at checkout, or, for international orders, import duties and taxes (see our Shipping Policy). If a product is listed at an incorrect price because of an error, we may cancel the order and refund any amount paid.

3. Orders and payment

Your order is an offer to buy. The contract is formed when we confirm and ship your order. We may refuse or cancel an order, for example if the product is unavailable or we suspect fraud, and in that case we will refund the full amount paid. Orders paid by bank transfer are held for 3 business days; if we don't receive the payment within that time, the order may be cancelled.

4. Shipping

Shipping times, costs and the treatment of duties and taxes are described in our Shipping Policy, which forms part of these Terms.

5. Returns and refunds

Returns are governed by our Refund Policy, which forms part of these Terms.

6. Your account and conduct

You are responsible for keeping your account details accurate and secure. You agree not to misuse our site, for example by attempting to interfere with how it works, accessing it by automated means for unlawful purposes, or using it for fraud.

7. Intellectual property

All content on holachela.com — including the CHELA name and logo, designs, photos, videos and text — belongs to CHELA or its licensors and may not be used without our written permission.

8. Reviews and content you send us

If you send us reviews, photos or comments, or tag us on social media, you allow us to use, reproduce and publish that content in connection with CHELA, with credit where appropriate. Please don't send content that is unlawful or that violates the rights of others.

9. Limitation of liability

To the extent permitted by law, CHELA is not liable for indirect or consequential damages arising from the use of our site or products, and our total liability for any order is limited to the amount paid for that order. Nothing in these Terms limits liability that cannot be limited by law.

10. Your rights as a consumer

These Terms do not affect any rights you have under the consumer protection laws of your country of residence. If any provision conflicts with those laws, the mandatory law prevails.

11. Governing law

These Terms are governed by the laws of the State of Florida, United States, without prejudice to the mandatory consumer protection rules of your country of residence.

12. Changes

We may update these Terms. Changes apply to orders placed after they are published.
